§ 73.05. HELMETS REQUIRED FOR TWO-WHEEL MOTOR VEHICLE OPERATORS.

  • (A) For the purpose of this chapter, it shall be illegal for any person under 18 years of age to operate or use a two-wheel motor vehicle without the use of an approved safety helmet on any city street within the jurisdictional confines of the city.
    (B) (1) The term TWO-WHEEL MOTOR VEHICLE includes any vehicle having two wheels and having a motor vehicle propulsion engine.
    (2) The term TO OPERATE AND USE includes both the vehicle operator and any passenger(s) who may ride on said vehicle.
    (3) The AGE OF THE VEHICLE OPERATOR OR USER shall be determined on the date of the alleged offense.
    (4) An AUTHORIZED SAFETY HELMET shall be any safety helmet which has been approved for use by the Department of Transportation.
